PERSONAL ASSISTANT DIRECTORY TERMS & CONDITIONS
For the purpose of these Terms & Conditions, Western Isles Community Care Forum will hereinafter be referred to as WICCF.
1. General
When you register to join WICCF’s Personal Assistant Directory you agree to abide by these terms and conditions. These terms and conditions may be varied by WICCF from time to time and it is your responsibility as a Member to keep up to date with the terms and conditions.
We require personal assistants who sign up to be a member of the PVG (Protecting Vulnerable Groups) scheme and to be able to provide WICCF with a PVG reference number.
The information contained in this web site does not represent any statement by WICCF as to the suitability or otherwise of the personal assistant. It is a signposting service. Likewise, any contracts of employment entered into are the responsibility of the Personal Assistant.
2. Scope of Service
WICCF provides a web based signposting service for prospective employers of personal assistants. WICCF posts the information provided by PAs and provides members with a search and contact facility. WICCF has no involvement concerning matching or recommending members to a prospective employer.
3. Subscribing
WICCF can provide the following training to Personal Assistants at the shown costs:
Moving & Handling Training - £50 |
Personal Foot Care Training - £10 |
Moving & Handling Refresher - £30 |
These charges could be subject to change.
4. Membership
WICCF may immediately terminate your membership without warning if you breach any of these terms and conditions (as may be amended from time to time).
You may terminate your membership at any time, for any reason, effective upon receipt by us, by emailing a notice of termination to
info@wiccf.co.uk However, you acknowledge and agree that you will not be entitled to any refund of any membership fees to WICCF.
5. Our responsibilities
We will respect your information and will comply with all applicable data protection legislation in force in Scotland. At times we may be required to disclose your personal information to contracted third party suppliers where this is necessary to fulfil our obligations to you. Such third party suppliers shall only be entitled to use your personal information to fulfil its obligations to WICCF. By becoming a Member of WICCF PA Directory you are consenting to WICCF using your personal information to provide the services and provide you with information about training and/or services offered by WICCF which may be of interest to you and also to your personal information being passed to third party suppliers where necessary. If you do not wish your details to be disclosed to contracted third party suppliers, then please email
info@wiccf.co.uk stating this in writing. In order to maintain the integrity of this website, we reserve the right to forward your contact details to any regulatory authorities when requested to do so, including the police.
6. Potential Employer Responsibilities
You are responsible for any information that you give which must be specific and relate to your current needs. You agree that you are solely responsible for ensuring the suitability of candidates for the vacancy you have. It is recommended that you undertake a face to face interview, take steps to verify previous employment and qualifications, take up character and work references, undertake a PVG check and other actions you consider necessary to confirm the integrity of a candidate. You also agree that age, gender or ethnicity data or any other such information provided by an applicant will not be used in any employment-related decision you make. However, this is your responsibility and WICCF accepts no responsibility or liability for the placing of a candidate.
7. Personal Assistant profiles
If a Personal Assistant is no longer available for employment, please ensure you notify WICCF by emailing:
info@wiccf.co.uk. Also please advise as soon as possible of any changes to profile details.
If you are not able to supply a valid email address, your contact telephone number(s) will appear on the web site.
All contents of Personal Assistant profiles are subject to our approval. We reserve the right in our sole discretion to reject or remove any personal assistant profile at any time if we believe in good faith it fails to conform to applicable laws and regulations, our policies of the public interest.
8. Service access
While WICCF will endeavour to ensure the availability of this website we do not guarantee that it will be uninterrupted or error free.
In addition, access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
9. Commercial use by members
Members may not use the services offered through this website or the website itself for illegal and/or unauthorised uses, including collecting telephone numbers, usernames and/or email addresses of Members by electronic or other means, for the purpose of sending unsolicited email and unauthorised framing of or linking to the website. Any such action will be investigated, and appropriate legal action may be taken, including without limitation, civil, criminal and injunctive remedies.
10. Use by agencies
WICCF Personal Assistant Directory is not specifically set up to cater for agencies, therefore does not encourage the use of the service by agencies.
11. Exclusion of liability
Except where expressly provided in law, WICCF shall be under no liability whatsoever to Members or any third party for any defect in, failure of, or unsuitability or unfitness for any purpose of this website offered by WICCF through this website of or third party equipment or software used to access the website or for infringement of rights or any other cause. In any event WICCF maximum liability relating to the services provided by WICCF through this website, for any reason whatsoever, including without limitation for breach of contract, breach of statutory duty or negligence, shall be limited to [£100].
12. Law
These terms and conditions and your use of the services offered through this website shall be governed by Scottish law and the parties shall submit to the non-exclusive jurisdiction of the Scottish Courts. If any provision of these terms and conditions is held invalid, the remaining provisions shall continue in full force and effect. The headings are for convenience only and shall have no effect on interpretation.
